Use of the site
Eligibility
By accessing or using bdgwinofficial.in.net (the "Site"), you confirm that you are at least 18 years of age, legally permitted to use gaming and prediction platforms under the laws applicable to you in India, and are accessing the Site voluntarily and on your own account.
Permitted use
You may use the Site solely for lawful, personal, and non-commercial purposes. You agree not to copy, reproduce, or commercially exploit any part of the Site without prior written consent from BDG Win; attempt to gain unauthorised access to any account, server, or network connected to the Site; use automated tools, bots, or scrapers to interact with the Site; or submit false, misleading, or fraudulent information during registration or any transaction.
Account responsibility
You are solely responsible for maintaining the confidentiality of your login credentials. Any activity conducted through your account is your responsibility. BDG Win reserves the right to suspend or terminate accounts found in violation of these Terms without prior notice.
Intellectual property
Ownership
All content on the Site, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, and software, is the exclusive property of BDG Win or its licensors and is protected under applicable Indian and international copyright, trademark, and intellectual property laws. The BDG Win name, logo, and all related marks are registered or common-law trademarks that may not be used without our explicit written permission.
Limited licence
BDG Win grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes only. This licence does not include the right to reproduce, republish, or distribute any Site content in any form; modify or create derivative works based on any Site content; or frame or mirror any portion of the Site on another website or service.
User-submitted content
If you submit any content to the Site, such as feedback or support communications, you grant BDG Win a worldwide, royalty-free, irrevocable licence to use, reproduce, and adapt that content for operational and promotional purposes. You represent that you own or have all necessary rights to any content you submit and that it does not infringe any third-party rights.
Limitation of liability
Disclaimer of warranties
The Site and all its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. BDG Win does not warrant that the Site will be free from errors, viruses, or interruptions, or that any defects will be corrected within a specific time frame.
Cap on liability
To the fullest extent permitted under applicable Indian law, BDG Win, its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site; unauthorised access to or alteration of your account or data; any loss of profits, goodwill, or business opportunities; or errors, omissions, or inaccuracies in Site content. In no event shall BDG Win's total aggregate liability to you exceed the amount you paid, if any, to access or use the Site in the three (3) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless BDG Win and its affiliates, officers, directors, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of your violation of these Terms, your use of the Site, or your infringement of any third-party rights.
Governing law
Applicable law
These Terms of Service and any dispute or claim arising out of or in connection with them, including non-contractual disputes, shall be governed by and construed in accordance with the laws of India. Specific provisions relating to online gaming and digital platforms shall be interpreted in light of the Information Technology Act, 2000, and any rules or regulations promulgated thereunder, as amended from time to time.
Jurisdiction and dispute resolution
Any dispute arising out of your use of the Site or these Terms that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the competent courts located in India. BDG Win encourages you to contact us first at [email protected] to seek an amicable resolution before initiating any formal legal proceeding. We aim to acknowledge all formal complaints within 7 business days.
Severability and entire agreement
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and BDG Win with respect to your use of the Site and supersede all prior agreements, representations, and understandings.
